We are a group of Ugandans based in Germany and our association keeps us together so that we can share and exchange information that is of use in all our undertakings, be it in Germany or elsewhere in the diaspora. Our organisation is non profit making and runs as a charity with an elected executive who are not paid for all the work they do. We are a member of the African Council in Berlin and belong to the Migrations Council that deals with problems of intergration and racial discrimination. The name of our organisation is: "Uganda Community in Berlin e.V", which is a registered organisation at the German registry of Charitable organisations. The Executive committee comprises of the Chairman/Chairlady, the Secretary, the Treasurer and two Ex-Officio Members whose tenure of office is one calendar year. The Executive Committee continues to operate in the name of the association until a new team is voted into office. Below is the constitution of the association. Constitution of the Uganda Community in Berlin (UCB) e.V. (revised edition) The Preamble: Considering our social and cultural background, Ugandans resident in Berlin have decided to create a Union. According to the geman laws on registration of associations, we have decided to draw the statute as follows:- § 1. Name and Seat of the Organisation: The Union shall be called "Uganda Community in Berlin (UCB) e.V." and shall have its seat in Berlin. The Union shall operate in accordance with the german regulations on charitable organisations and shall abide by the rules in all its dealings as a charity organisation. § 2. Aims and Objectives of the Union: The aim of the Union is to intergrate Ugandans of all walks of life and to encourage them to promote Ugandan culture. The Constitution shall allow the Union to organise Cultural shows, Exhibitions, discussions on Political and Scientific topics. § 3. Charitable Organisation: 3.1 The Union shall be non profit making and its objectives are not underlined by financial interests. 3.2 Income and property of the Union shall be used in accordance with the constitutional regulations. The members shall not take or share any assets of the Union for their own personal use. 3.3 Nobody shall recieve a high financial reward (contrary to charity regulations) for services rendered to the Union. § 4. Membership A member shall be any natural person. 4.1 The Union shall consist of full members (voting members) and Associate members (non voting members):- (a) Full members shall be Ugandans resident in Germany and former Ugandan citizens who have agreed to obey to the aims and objectives of the Union. They can vote or be voted into office when they have reached 18 years of age. (b) Honorary members shall be persons who exceedingly support and promote the objectives of the Union. Honorary members have voting rights. (c) Associate members shall be all natural and legal persons, who support the objectives of the Union. They have a right to propose and discuss but they cannot vote or be voted into office. 4.2 All applications for membership shall be in writing. 4.3 Any member can resign from the Union. The resignation shall be in a written form. 4.4 Any member shall be expelled if his / her Conduct damages the functioning of the Union. the general Assembly shall decide on the expulsion. § 5. The Union and its Organs The Union "Uganda Community in Berlin (UCB) e.V." shall exist when at least seven active members are available. The main bodies of the Union shall consist of :- (a) The General Assembly (b) The Executive Committee. The General Assembly shall decide on expanding the committee for organisational purposes with specific duties. § 6. The General Assembly 6.1 The General Assembly shall be the supreme Organ of the Union. 6.2 Duties, Rights and Powers of the General Assembly:- (a) To elect the Executive Committee / Organising Committtee. (b) To relieve the Executive Committee of their duties at the end of the Calender year. (c) To decide on the Amendment of this constitution and the liquidation of the Union. (d) To decide on the expulsion of a member / members from the Union. (e) To elect the two (2) Auditors who are not members of the Executive Committee and who shall give a report on the balance sheet of the Union. 6.3 Summon and Resolutions of the General Assembly (a) The General Assembly shall convene when more than half the members form a quorum. The invitation to the General Assembly shall be done by the Executive Committee and shall be in written form with the proposed Agenda that should be two weeks before the meeting. (b) The General Assembly shall meet thrice a year. An extraordinary General Assembly shall be called upon when a third of the members so wish and have made a written application. (c) The Resolutions of the General Assembly are binding when voted by a simple majority of those present. (d) Each active member shall be entitled to only one vote for a particular session at the time of voting. Voting shall be done by secret ballot or by show of hands when the majority of those present so wish. (e) To amend the Constitution or expel a member from the union, shall require three quarters of the votes of the General Assembly. |
